Dale Farm eviction appeal defeated

The evictees of Dale Farm have lost their appeal to be housed in an alternative site appropriate for caravans, rather than the council housing they were offered. John and Barbara Sheridan, along with Mary Flynn, had previously been defeated at Southend County Court.
The trio argued that Basildon Council’s Homelessness Strategy should have displayed more sensitivity when it came to the eviction process, particularly as Mrs Sheridan had claimed that living in a conventional house causes her to suffer bouts of depression.
It is hoped that this ruling will bring an end to the legal wrangling that has continued since the Essex site was cleared last year.
Galina Ward – who, as an in-house barrister for Basildon Borough Council holds one of the most important legal jobs in the area – was successful in her attempt to persuade Sir Andrew Morritt, Lord Justice Patten and Lord Justice Pitchford that the travellers were not necessarily entitled to relocation on the terms they wanted.
